Protecting your personal data matters to us. This privacy policy explains which data we process when you visit our website, order from our online shop or get in touch with us, why we do so and what rights you have.
1. Controller
The controller responsible for data processing is:
Raum & Duft Konzept AG
Brown Boveri Platz 3
5400 Baden, Switzerland
Email: info@raumundduft.ch
Phone: +41 56 221 88 88
For questions about data protection and to exercise your rights, contact us at info@raumundduft.ch or at the address above.
2. Legal basis
We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP). Where the EU General Data Protection Regulation (GDPR) applies in an individual case, we rely on the following legal bases: performance of a contract or pre-contractual measures (Art. 6(1)(b) GDPR), legal obligations (point (c)), our legitimate interests (point (f)) – for example in the secure operation and improvement of our website – and, where required, your consent (point (a)).
3. What data we process
3.1 Visiting the website
When you access our website, technically necessary data is transmitted to the server and briefly stored in log files: IP address, date and time of access, page requested, browser and operating system, and the previously visited page. We need this data to deliver the website, ensure its security and resolve faults. We do not use it to identify you personally.
The website’s fonts are loaded from our own server. No data is transmitted to external font providers.
3.2 Audience measurement with Umami
To understand how our website is used and to improve it, we use the analytics service Umami (Umami Software, Inc., USA). Umami sets no cookies, does not store IP addresses and does not create user profiles. It records aggregated, non-personal information such as pages viewed, time on page, referring page, device type, browser and country.
We also count individual events, for example when a product is added to the cart, checkout is opened, an enquiry is sent or the room calculator is used. We only transmit technical details such as the product name or room size – never names, e-mail addresses or message content.
This processing is based on our legitimate interest in improving our offering.
3.3 Contacting us
If you contact us via the contact form, by e-mail or by phone, we process the information you provide – such as name, company, e-mail address, phone number, industry, room size and the content of your message – in order to answer your enquiry and advise you. Mandatory fields are marked in the form.
3.4 Orders in the online shop
To process your order, we process your contact and address details (name, company, billing and delivery address, e-mail address, phone number), the products ordered, prices and your comments. Payment by credit or debit card or TWINT is handled by an external payment service provider; your card and payment details go directly to that provider and are not stored by us. We only receive confirmation of payment.
Our online shop and checkout run on the Shopify shop system (Shopify International Ltd., Ireland); Shopify processes order and payment data on our behalf. For delivery, we pass your name and delivery address to the appointed carrier. We retain invoices and accounting records in accordance with our statutory obligations.
3.5 Newsletter
If you subscribe to our newsletter, we process your e-mail address and, if provided, your interest (home or business) in order to send you news, seasonal scents and offers. Sign-up uses a double opt-in process: you are only subscribed once you click the link in our confirmation e-mail. We use a specialised e-mail service provider for sending. You can unsubscribe at any time via the link in every newsletter or by e-mailing us; your address will then be removed from the mailing list.
3.6 Scent samples, scent subscription and gift enquiries
For scent sample orders, the scent subscription and corporate gift enquiries, we process your contact details, delivery address and selection in order to process the order, schedule recurring deliveries or prepare a quote for you.
3.7 Customer relationship and projects
For consultations, quotes, scent concepts, refill and service orders, we process the necessary information about your company, your contact persons and premises in order to plan and carry out the order and support you over the long term.
4. Cookies and local storage
We only use technically necessary cookies, for example to keep your cart. We do not set cookies for advertising or analytics purposes. You can find details in our Cookie Policy.
5. Disclosure to third parties
We do not sell your data. We only disclose personal data where necessary, namely to:
- providers of hosting and technical operation of our website and online shop,
- Umami for cookie-free audience measurement (see section 3.2),
- payment service providers for processing card and TWINT payments,
- carriers for the delivery of your order,
- service providers for IT, e-mail, newsletters and accounting,
- authorities, where we are legally required to do so.
Our service providers process personal data only on our behalf and in accordance with our instructions, and are bound by confidentiality.
6. Disclosure abroad
Some service providers may also process data outside Switzerland, in particular in the EU or the USA. We only disclose data to countries without adequate data protection if appropriate safeguards are in place – such as the recipient’s certification under the Swiss-U.S. Data Privacy Framework or the European Commission’s standard contractual clauses recognised by the Federal Data Protection and Information Commissioner (FDPIC).
7. Retention
We retain personal data only for as long as necessary for the respective purpose. Enquiries that do not lead to an order are generally deleted after two years at the latest. Business records, invoices and receipts are retained for the statutory period of ten years. Server log data is deleted after a short time.
8. Data security
We take appropriate technical and organisational measures to protect your data against loss and unauthorised access. Transmission between your browser and our website is encrypted (HTTPS).
9. Your rights
Within the scope of applicable data protection law, you have the right to
- request access to the personal data we hold about you,
- have inaccurate data corrected,
- request erasure or restriction of processing,
- object to processing and withdraw any consent given at any time,
- receive your data in a common electronic format (data release and portability).
Please send your request to info@raumundduft.ch. We may ask you to verify your identity. Statutory retention obligations remain reserved.
You also have the right to lodge a complaint with the competent supervisory authority – in Switzerland the Federal Data Protection and Information Commissioner (FDPIC), and within the scope of the GDPR the supervisory authority of your country of residence.
10. No automated decisions
We do not make automated individual decisions and do not carry out profiling.
11. Links to other websites and social networks
Our website contains links, for example to LinkedIn. Data is only transmitted to the respective provider once you click such a link; that provider’s privacy policy then applies.
12. Changes
We may amend this privacy policy if our offering or the legal requirements change. The version published on this page at any given time applies.
